They are not allowed to use your information for any purpose other than providing services to Fast Affordable Kitchens, and they must keep it confidential. Similarly, our email communications may be handled by an email service provider. These providers will have access to contact information solely for the purpose of sending communications on our behalf. They are not permitted to use your data for their own marketing.

No Third-Party Marketing Sharing: We do not share your personal information with unrelated third parties for their own marketing or advertising purposes. For example, we will not sell or give our customer email list to another company so they can market to you. Your information is used only by us and our service providers as explained above.

We value open communication with our customers. Here’s how we handle phone calls, emails, and text messages, and how we respect your preferences:

  • Phone Calls: If you provide your phone number to us (for example, when requesting a quote or consultation), we will use it to call you about your inquiry or project. This may include confirming appointment times, discussing project details, or following up on any issues. We will typically call during normal business hours. We do not use automated robocalls. By providing your phone number, you agree that we may call you for these purposes. If at any time you prefer not to receive phone calls from us, please let us know and we will note your preference.

  • Text Messages: We may also use text messaging (SMS or MMS) to communicate with you, especially if it’s convenient for quick updates or confirmations. For example, we might text to confirm an appointment or let you know the crew is on the way. We will obtain your consent before sending text messages for marketing purposes (and currently, we do not send marketing texts). Standard messaging rates from your carrier may apply. You can opt out of receiving texts at any time by replying “STOP” to any text we send, or by contacting us and asking to be removed from text communications. We will comply promptly with such requests.

  • Emails: We use email to send you information you’ve requested, as well as to communicate updates about your project. If you provided your email via our contact form or in correspondence, we will email you to respond and follow up. We may also occasionally send newsletters or promotional emails about new services, special offers, or home improvement tips if you have given us permission or if you are an existing customer who would reasonably expect such communication. Each marketing email will include an unsubscribe link so you can opt out of future emails. Transactional or service-related emails (like quotes, invoices, or scheduling communications) will still be sent as needed even if you opt out of marketing messages.

  • Respecting Your Preferences: You can inform us at any time if you prefer certain communication channels. For instance, if you’d rather receive a text than a phone call (or vice versa), we will do our best to accommodate. Similarly, if you do not want to be contacted for promotional purposes, we will honor that. We aim to be compliant with the Telephone Consumer Protection Act (TCPA) and Florida telemarketing laws, meaning we will not spam you and will seek any necessary consent for communications like texting or automated dialing (which, again, we generally do not use).

  • Record-Keeping: For quality assurance and legal compliance, we may keep records of our communications with you (such as saving emails or logging call details). These records are kept secure and only for as long as necessary (see “Data Retention” below).

  • Secure Platform: Our website is hosted by Wix, which employs security features such as HTTPS encryption (look for the padlock in your browser’s address bar when visiting our Site), firewalls, and other industry-standard protections.   • Payment Information: (Note: We typically do not collect payment information through our website. If in the future we enable online payments or accept credit card info on the Site, we will use secure payment processors and do not store full credit card numbers on our systems. Any such changes will be reflected in this policy.)

  • Third-Party Security: We ensure that our third-party service providers (like Wix and Google) also use appropriate security measures. For example, Google Analytics only provides us access to aggregated data through a secure dashboard, and Wix’s infrastructure is designed with security in mind.

  • Data Breach Procedures: Despite our best efforts, no website or internet transmission is completely secure or error-free. In the unlikely event of a data breach or security incident affecting your personal information, we will notify you and the appropriate authorities as required by Florida’s data breach notification law (the Florida Information Protection Act). We will do so as soon as possible and within any timeframes required by law (typically, Florida law requires notification to affected individuals no later than 30 days after determination of a breach of unencrypted personal information).

Your Role in Security: Please also do your part to protect your personal information. When communicating with us, especially via email, do not send sensitive personal information (like credit card numbers or social security numbers). We will never ask for such information via email or text. If you have reason to believe that your interaction with us is no longer secure (for example, if you suspect your personal data has been compromised), contact us immediately so we can investigate and address the issue.

 

Data Retention

We will retain your personal information only for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

  • If you contact us for an estimate or inquiry but do not ultimately use our services, we may retain your contact information and communications for a reasonable period in case you have follow-up questions or decide to proceed later, and to improve our services based on your inquiry.

  • If you become a customer, we will retain the information relevant to the services provided (including contact details and project records) for as long as the customer relationship continues and for a period thereafter as required by business needs (e.g., warranty or maintenance purposes) or legal requirements (e.g., keeping records for tax purposes).

  • We also retain any information required to comply with our legal obligations or resolve disputes. For instance, we may retain certain correspondence or records to demonstrate compliance with privacy laws or contractual obligations.

When we no longer have a legitimate need or legal obligation to keep your personal information, we will securely dispose of it. This may involve deleting electronic records in a secure manner and shredding any physical documents containing personal data.

You may also request a copy of the specific pieces of personal information we have about you.

  • Right to Delete: You can request that we delete personal information we have collected from you. Upon verification of your identity, we will delete your personal information from our records, and direct any service providers to do the same, unless an exception applies (for example, if we are required to keep certain data to comply with a legal obligation or if the data is needed to complete a transaction you requested).

  • Right to Opt-Out of Sale or Sharing: You have the right to direct us not to sell your personal information or share it for targeted advertising purposes. However, as noted, we do not sell personal information or use it for cross-site behavioral advertising. Therefore, your information is not being sold or shared in a way that would trigger this opt-out right. (If this ever changes, we will update our practices and honor opt-out requests.)

  • Right to Opt-Out of Marketing Communications: Even outside of formal “Do Not Sell” requests, you can always opt out of our marketing emails or texts as described in Communication Practices above. Simply use the unsubscribe link in an email or reply “STOP” to a text, or contact us with your request. We will promptly remove you from promotional lists.

  • Non-Discrimination: We will not discriminate against you for exercising any of these rights. For example, we will not deny you services or charge you different prices or provide a different quality of service because you exercised your privacy rights. Our service to you will remain the same regardless of your privacy choices.

  • Authorized Agents: If you prefer, you may designate an authorized agent (such as an attorney or someone else you trust) to make requests on your behalf. We will take steps to verify that any person purporting to act on your behalf is authorized to do so.

How to Exercise Your Rights: To make any request regarding your personal information, please contact us using the information in the Contact Us section. Please describe your request with as much detail as possible to help us respond effectively. For your protection, we will need to verify your identity (for example, by confirming information we already have on file, like your contact details) before fulfilling certain requests, especially for access or deletion of data. We will respond to verifiable requests free of charge within the time frame required by law (generally within 30 days for Florida residents, with the possibility of a reasonable extension if needed). If we need more time or cannot fulfill your request (due to a legal exception), we will inform you of the reason and the extension period in writing.

  • Florida Digital Bill of Rights (Effective July 1, 2024): Florida has enacted a comprehensive privacy law that grants consumers specific rights over their personal data (many of which are outlined in the Your Privacy Rights and Choices section above). We have designed our Privacy Policy and practices to align with these requirements. For example, we provide transparency about our data practices, honor requests to access or delete data, and refrain from selling personal information. This law also defines a “child” as anyone under 18 and requires parental consent for certain data practices involving minors. As noted in Children’s Privacy, we do not knowingly collect data from minors under 18, in compliance with this aspect of the law.

We also intend to adhere to any other applicable privacy regulations, whether at the federal level (like the Children’s Online Privacy Protection Act (COPPA) for minors under 13, or the Telephone Consumer Protection Act (TCPA) for communications) or other state laws that might apply. Because our business is focused on Florida residents, Florida law is our primary governing law for privacy, but if you are visiting from another state or jurisdiction with relevant privacy requirements (e.g., a state with its own consumer privacy law), we will make good faith efforts to respect those as well.

Children’s Privacy

Our services and website are not directed to anyone under the age of 18. We do not knowingly collect personal information from minors (children under 18 years old). Fast Affordable Kitchens is a home remodeling service typically aimed at adult homeowners and we have no content intended for children.
